- Criminal Liability — In cases of serious negligence, repeated violations, or workplace accidents, employers and company directors may face criminal prosecution, personal liability, and in extreme cases, prison sentences.
- Labour Inspection Measures — Belgian labour inspectors may request all SDGR-related documents, conduct on-site inspections, issue warnings, impose corrective measures, suspend work activities, or order partial or total closure of the company in situations of imminent danger.
- Civil Liability and Compensation — If an accident or occupational disease occurs and the SDGR is missing or incomplete, the employer may be held civilly liable. Victims may claim financial compensation, and insurance companies may reduce or refuse coverage or seek reimbursement.
- Increased Risk After Workplace Accidents — Without a valid SDGR, the employer is presumed to be at fault. The burden of proof shifts against the employer, significantly weakening any legal defense.
