What happens if I don't have an SDGR?

SDGR – Fines, Risks and Consequences of Non-Compliance (Belgium)

  • Legal Sanctions and Fines — Failure to comply with the Belgian SDGR obligations may result in administrative fines ranging from €400 to €4,000 per violation, and criminal fines ranging from €800 to €8,000 per violation. These fines may be multiplied by the number of affected employees, potentially reaching very high amounts in serious cases.
  • Criminal Liability — In cases of serious negligence, repeated violations, or workplace accidents, employers and company directors may face criminal prosecution, personal liability, and in extreme cases, prison sentences.
  • Labour Inspection Measures — Belgian labour inspectors may request all SDGR-related documents, conduct on-site inspections, issue warnings, impose corrective measures, suspend work activities, or order partial or total closure of the company in situations of imminent danger.
  • Civil Liability and Compensation — If an accident or occupational disease occurs and the SDGR is missing or incomplete, the employer may be held civilly liable. Victims may claim financial compensation, and insurance companies may reduce or refuse coverage or seek reimbursement.
  • Increased Risk After Workplace Accidents — Without a valid SDGR, the employer is presumed to be at fault. The burden of proof shifts against the employer, significantly weakening any legal defense.
  • Psychosocial Risk Violations — Failure to manage psychosocial risks such as stress, burnout, harassment, or violence at work may lead to additional sanctions, formal employee complaints, and intervention by prevention authorities.
  • Reputational and Business Impact — Non-compliance can seriously damage the company’s reputation, reduce employee trust, affect client relationships, and limit access to public tenders or certifications.

Mandatory Nature of the SDGR

The SDGR is mandatory for all employers in Belgium, regardless of company size or sector, starting from the first employee.
